Halle Berry ex Gabriel Aubry alleges he was threatened, attacked

The already complex situation involving Gabriel Aubry, Olivier Martinez and Halle Berry saw a new twist Monday as Aubry, Berry’s ex-boyfriend, filed a complaint with police detailing his injuries from a Thursday fight with Martinez, Berry’s fiancé.

Berry and Aubry have been embroiled in a custody dispute over their 4-year-old daughter Nahla, with the actress recently fighting unsuccessfully to be allowed to relocate the girl to France.

In court papers filed Monday, Aubry said he suffered a fractured rib, facial bruises and cuts that required stitches, according to L.A. Now. TMZ has nasty pictures of the damage done to the male model’s mug. The civil court filing allowed a judge to issue a restraining order keeping Martinez away from Aubry. An order keeping Aubry away from Berry was filed last week.

Also in the complaint, TMZ reports, Aubry alleged that on Wednesday Martinez had, in a whisper, threatened to kill him. The adults were attending Nahla’s school play at the time. The fistfight between the two men broke out the next morning in the driveway outside Berry’s house when Aubry brought Nahla over around 10 a.m.

Aubry claims, according to People, that during the fight Martinez additionally said, “You cost us $3 million [in legal fees for the custody battle]. When you see the judge, you’re going to tell him you’re going to Paris or I’m going to kill you.”

Martinez has said Aubry was the aggressor, according to police. In Aubry’s filing, he reportedly said he was attacked without provocation. TMZ sources said Aubry did not mention the threats to police when he spoke to them immediately after the fight, and a People source close to Berry said it didn’t go down as Aubry described.

Berry and Nahla were not present outside the house when the altercation went down, the court papers said.

After being treated for his injuries Thursday, Aubry was arrested on suspicion of misdemeanor battery and later released on $20,000 bail. He’s due in court Dec. 13.
