Darren Sharper: No charges filed in alleged Miami assault case

Former NFL star Darren Sharper, who is being held in an L.A. County jail, will not face assault charges in Miami after prosecutors determined there was insufficient evidence to file, records show.

The latest development in the Sharper criminal case was revealed when his attorneys filed a motion to prompt Los Angeles County prosecutors to turn over more details of their investigation.

Los Angeles Superior Court Judge Renee Korn will hear that motion Friday morning.

Sharper’s attorneys, Blair Berk and Leonard Levine, took the opportunity to attempt to undermine the evidence in the multiple-state investigations their client is facing.

They revealed that prosecutors in Miami declined to file charges based on allegations made by a woman who came forward Jan. 19, three months after she had contact with the former Super Bowl winner.

The woman made the allegations after Sharper was charged with two rapes in Los Angeles.

Sharper, 38, is accused of drugging and assaulting eight women in four cities: Los Angeles, Las Vegas, New Orleans and Tempe, Ariz.

Sharper, a former safety, is charged in Los Angeles with drugging and attacking two women he met at a West Hollywood club in two separate incidents. He was indicted for a similar crime in Arizona.

He is being held without bail in Los Angeles County jail. He initially posted bail and was released but was taken into custody again in late February after New Orleans police issued a warrant for his arrest in connection with the case there.

Prosecutors in Arizona then charged Sharper, and a judge ordered him held in Los Angeles.

Sharper’s attorneys alleged in a court motion that DNA from other men was found on the two women in Los Angeles after the alleged assault. The attorneys claim prosecutors had obtained the names of the men connected to the DNA but had yet to provide them to the defense.

In the Arizona case, Sharper’s attorneys allege the lead detective fabricated testimony on the witness stand during a hearing when he testified Sharper’s semen had been found on a woman’s leggings. He later admitted it had not been found, saying that he learned from the LAPD that Sharper had undergone a vasectomy, Sharper’s attorneys said.

The attorneys said in the motion that the detective never spoke to the LAPD, and an Arizona prosecutor later said the detective learned about it from the woman.

In the Las Vegas investigation, a new witness has come forward saying Sharper had “very rough sex” with one of the victims within 24 hours of the alleged January incident.

The woman in a text to the witness did not mention rape and even made a joke about Sharper’s sexual involvement with her friend (the other accuser), the attorneys said in a motion.

Berk and Levine wrote in their motion that a key witness for the prosecution in New Orleans is under criminal investigation for allegedly drugging a woman in a bar in an unrelated incident.
