Second Suit Filed in Sniper’s Slaying of Girl, 11, on Playground at L.A. School
The father of 11-year-old Shala Eubanks, who was killed last February when a sniper sprayed the 49th Street Elementary School playground with gunfire, is seeking an unspecified amount of damages in a wrongful death suit filed Tuesday against the Los Angeles Unified School District, the school’s principal and its vice principal.
Eddie Eubanks contended in his Los Angeles Superior Court civil suit that school officials had heard gunshots coming from the home of Tyrone Mitchell weeks before the attack and knew Mitchell was mentally deranged. Yet officials failed to warn Eubanks or his daughter of the danger, the suit said.
The victim’s mother, Sandra Jenkins, was also named as a defendant because she did not join Eubanks’ suit as a plaintiff. Jenkins filed a similar suit seeking $3.5 million in damages last month.
Mitchell, 28, apparently killed himself before police rushed his home across the street from the school.
