As expected, a lawsuit was filed Thursday in Vista Superior Court challenging the validity of an initiative scheduled to be put to a vote April 30, which, if deemed legal, could block the construction of a controversial trash-fired power plant. The lawsuit, filed by North County Resource Recovery Associates, alleges the proposed ordinance is unconstitutional because it would require a two-thirds approval of voters before the plant could be built, and then only after a similar one is constructed elsewhere in California. Recovery Associates says such a condition is discriminatory.
