NEW YORK — A state judge today approved the use of FBI wiretaps as evidence in the criminal case against former Labor Secretary Raymond J. Donovan, rejecting arguments that the surveillance was based on FBI lies to a federal judge.
The ruling allows Bronx prosecutors to retain what they say is important evidence in their case charging Donovan and nine other construction executives with fraud in a subway tunnel project. State Supreme Court Justice John P. Collins set Jan. 6 for a final pretrial conference to set a trial date.
