A state appeals court in Trenton, N.J., struck down a state education department policy that requires schools to admit children with AIDS, saying officials failed to provide adequate time for public comment before adopting the regulation. The appeals court directed Education Commissioner Saul Cooperman to devise new administrative rules and to hold a public hearing on them. The decision means two school districts that have fought the policy in court do not have to admit children with the disease.
