Maywood : Fernwood Suit Dismissed
A suit filed against the City of Maywood, the City Council and several city employees by the owner of the former Fernwood Hotel charging violation of civil rights has been dismissed in federal court.
Nick Mallas, principal shareholder of Apartments and Hotels Inc., which owns the hotel, filed suit in April after the city revoked the hotel’s nonconforming use permit. The suit challenged the city’s right to revoke the permit and sought damages.
The Fernwood, operating since the 1920s, is in an industrial zone and has been vacant since September, 1984, when the city obtained a preliminary injunction restricting occupation of the Fernwood until building and health and safety code violations were corrected. The city then revoked the hotel’s nonconforming use permit in February, .
While the building cannot be operated as a hotel, it can be used for various manufacturing and commercial uses, said City Atty. Cary Reisman.
