A jury Thursday found 22-year-old David Tucker guilty of voluntary manslaughter in the shooting death of an innocent bystander to a fight in Marina Village.
The San Diego Superior Court acquitted Tucker, of Linda Vista, of first- and second-degree murder in the Oct. 22 death of Charles Bryant, 31. Bryant was an independent music producer.
The jury also convicted Tucker of attempted manslaughter and assault with a deadly weapon upon Michael Moller, 26, the son of a police lieutenant.
Tucker shot at Moller outside a disco and attempted to run him down after some disparaging remarks about a woman were made. Moller said he kicked Tucker’s car before the shooting.
Seeing the altercation, Bryant dived into a nearby car to avoid being shot, but a stray bullet went through the trunk and car seat, hitting Bryant in the back.
Judge David Gill allowed Tucker to remain free on $100,000 bail.
Prosecutor Steven Anear said Tucker could be sentenced to 15 to 20 years on the charges.
This was the second time Moller had been involved in a shooting. On Dec. 22, 1981, Moller and a friend, Mark Steffen, were shot at by two off-duty sheriff’s deputies who had been drinking at a Hillcrest taco shop.
The deputies, Alan Wittig and Charles Bailey, were convicted in 1982 of assault with a deadly weapon in the wounding of Steffen.
