Fresno police said they will seek attempted murder charges against a suspected prostitute and her pimp because both knew she has acquired immune deficiency syndrome. Officers arrested Stephanie Smith, 36, and Reginald McMillan, 33, after being tipped that the woman had the disease. Officers said they watched the pair until McMillan solicited a man for a sex act with Smith and then made the arrests before the act could be completed. The case will be turned over to the district attorney’s office for review and the filing of formal charges, investigators said. Dist. Atty. Edward Hunt said the law requires that an intent to kill be shown in attempted murder cases. “I don’t think we’ll be able to show an intent to kill,” Hunt said. “We certainly can show a reckless disregard for public safety.”
