Minn. Loses National Guard Suit

Governors have no constitutional authority to withhold consent for National Guard training missions in Central America, a federal judge ruled today.

In a strongly worded 14-page opinion, U.S. District Judge Donald Alsop dismissed with prejudice a lawsuit filed by Minnesota and supported by several other states. Minnesota attorneys had challenged legislation signed into law by President Reagan on Nov. 14 providing that governors may withhold consent for foreign National Guard assignments only when the units are needed for local emergencies.
