The proposed merger of the A. H. Robins Co. and Rorer Group Inc. contains an escape clause that allows Rorer to call off the deal if the value of claims against Robins by women who allege injury from the use of the company’s Dalkon Shield is greater than $1.75 billion. The clause was part of the Richmond, Va.-based pharmaceutical company’s plan of reorganization submitted just before the latest deadline. Robins estimates that the claims are worth no more than $1.2 billion; the Dalkon Shield claimants committee said the claims are worth much more than $1.75 billion. A hearing is scheduled to start Nov. 5 to estimate the value of the claims.
