The Oregon Court of Appeals said that State Police acted illegally when they installed a peephole camera in a men’s restroom at a freeway rest stop in hopes of stopping illegal sex acts. The appeals court reversed the convictions of two men found guilty of illegal sexual activity in separate incidents. The court ordered new trials for the two and barred prosecutors from using evidence gathered with the camera. Oregon State Police had installed the camera in the wall of a restroom at a rest stop on Interstate 5 near Wilsonville. The camera was pointed at two door-less toilet stalls and could be activated if a nearby officer suspected illegal activity in progress, the court said. Police had no warrant to install the camera.
