McMartin Retrial Delayed Again for Lawyer’s Illness
A retrial of McMartin Pre-School defendant Ray Buckey was delayed again Friday, this time because of his lawyer’s medical problems, and prosecutors said they could lose their last three child witnesses if the delays continue.
Defense attorney Danny Davis sought a two-month continuance so he could have back surgery for a herniated disc, which a second physician who examined him Friday said may not be necessary after all.
Los Angeles Superior Court Judge Stanley Weisberg decided to postpone jury selection for two weeks, to April 9. Deputy Dist. Atty. Joe Martinez said the families of three girls expected to testify to eight counts of molestation at the Manhattan Beach nursery school are “very unhappy” about the delay.
Davis, who is being married today, had asked for time off for a wedding trip, but Weisberg denied the request.
