Roger Clemens’ agent says the incident that led to the arrest of the two-time Cy Young Award winner at a Houston nightclub early Saturday was “an unfortunate misunderstanding.”

Clemens, 28, and his 39-year-old brother, Gary, each remained free on $2,000 bond after being arrested for aggravated assault on a police officer during a disturbance at the Bayou Mama’s nightclub.

An initial appearance hearing has been scheduled for Tuesday in Harris County state district court, the district attorney’s office said. Harris County Assistant District Attorney Henry Lawrence said if convicted of the third-degree felony charges, the two brothers face two to 10 years in prison and up to a $10,000 fine.
