Man Told to Stay Clear of Pilar Wayne : Court relief: The Duke’s widow wins a restraining order against a man who she says is pestering her.

Pilar Wayne, widow of movie star John Wayne, was granted a temporary restraining order Tuesday against a Laguna Niguel man who she said has pestered her by sending her flowers, candy and “intimate” letters.

Wayne, who represented herself in court, said in a brief memo that the attentions of Charles Leroy Sunday has made her family uncomfortable.

Sunday “has continually sent letters which ramble and are offensive,” Wayne wrote. “I construe them to be of an intimate nature and not friendly. Most recently, he has sent flowers and candy with letters enclosed, creating a sense of uneasiness for myself and family members.”

The restraining order granted by Orange County Commissioner Greer Stroud prohibits Sunday from being within 100 yards of Wayne’s Newport Beach home, sending letters or telephoning her for three years. The provisions also apply to Wayne’s daughter, Aissa.

During the brief hearing, Sunday, 40, said he thought he was acting as a friend of the family. Sunday also represented himself at the hearing.

Neither Wayne nor Sunday could be reached for comment Tuesday after the hearing.

Newport Beach Police Sgt. Andy Gonis said Tuesday that Pilar Wayne told police on May 22 that Sunday was “stalking” her. Police investigated the complaint and interviewed Sunday.

“We have submitted the case to the district attorney’s office for review and the possible issuance of an arrest warrant,” Gonis said but declined to elaborate further on the case because the investigation was continuing.

Pilar and John Wayne were married for 25 years and had three children together. She chronicled her life with the actor in her 1987 book, “John Wayne: My Life With the Duke.” The actor died in 1979.

Aissa Wayne also lives in Newport Beach. In October, 1988, she was attacked along with her boyfriend Roger W. Luby in the garage of his Newport Beach home. Aissa Wayne’s ex-husband, Dr. Thomas A. Gionis, has been accused of masterminding the assault. Gionis’ first trial ended in a mistrial, and he is awaiting a second trial. Aissa Wayne’s face was smashed into the concrete floor several times, and Luby was beaten with a gun and cut.
