SAN JUAN CAPISTRANO : Developer Sues City Over Housing Plan
A developer sued the city this week after more than three years of trying to win approval for a 99-acre custom-home project.
Concorde Development, an Irvine-based developer, is asking an Orange County Superior Court judge to overturn the City Council’s rejection of the project. The developer claims the council’s decision amounted to a violation of his property rights.
The developer has been rebuffed by the council three times since November on a proposal to turn the acreage in the southeast corner of the city into 76 custom-home sites.
Council members say the project is too dense and damaging to the hillside. Neighbors in the adjacent Cannemara development agreed and asked the council to scale back the Concorde project.
Dennis Gage, president of Concorde Development, hinted last March that the only way to win concessions from the city was through a lawsuit.
“If you abide by the law and do everything in the code book, I don’t know what else you can do,” Gage said in March. “But we’re there for the long run, we have a fine project and we’re committed.”
Gage was out of town this week and could not be reached for further comment.
