Man Convicted of Murder in Mile Square Park : Crime: The prosecution argued successfully that Minh Cong Do abetted the execution-style slaying. Another suspect is brought here from Canada.

An Anaheim man was convicted of first-degree murder Friday for his participation in the execution-style slaying of a Los Angeles man in Fountain Valley’s Mile Square Park last year.

The conviction of Minh Cong Do, 19, came only hours after law enforcement authorities extradited another suspect who was arrested in Canada in connection with the September, 1990, shooting of Loa Le, 34, officials said.

Deputy Dist. Atty. Paul Odwald expressed satisfaction with Do’s conviction and said he was surprised to learn about the other suspect’s arrest.

A Superior Court jury deliberated only four hours Friday before convicting Do on one count of first-degree murder and two counts of attempted murder.

In their deliberations, jury members discounted alibis by eight of Do’s family members who said he was attending a family baby shower and church at the time Le was murdered, Odwald said.

If given the maximum sentence, Do could receive 25 years to life in prison.

Odwald called the conviction “a victory” for prosecutors who use an “aid and abet” theory of prosecution of criminal defendants who are involved in homicides but do not pull the trigger, as in this case.

The theory states that any one who agrees to become involved in a violent crime shares the same punishment for it, Odwald explained.

“I’m very satisfied with the verdict because I believe the killing of Mr. Le was a first-degree murder even though Minh Do did not fire the shot that killed him. He was still responsible for the crime,” Odwald said.

Do’s attorney could not be reached for comment.

Do’s alleged accomplice, Hao Day Thai, 25, was returned to Orange County late Thursday night after he was arrested by Toronto police, Orange County Sheriff’s Department spokesman Lt. Richard J. Olson said.

Thai, who was arrested June 7 at a Toronto airport, was the third suspect caught in the wake of the attack that also left Ngoc Lee Phung seriously wounded, Olson said.

Thai is being held in Orange County Jail and awaits a Monday arraignment on murder charges in Municipal Court in Westminster, Olson said. He is being held without bail.

Olson said that two other suspects remain at large--Hoang Xuan Nguyen, 23, and Phong (Paul) Chuhang Phan, 19, both of Santa Ana.

Odwald identified Nguyen as the alleged shooter. The prosecutor said that as Le lay on the ground, bleeding from bullet wounds in his leg and back, Nguyen allegedly walked up to him, put the gun to his head and fired.

During the trial, the prosecution brought three witnesses to the stand, who testified that Do was at the park the day of the shooting and not at a baby shower as Do’s family members told jurors.

Do turned himself in to Garden Grove police a week after the shooting, which occurred after Thai approached Le, Ngoc Lee Phung and two others, accusing them of setting the police on Thai’s girlfriend, Odwald said. The suspects and the victims lived in the same apartment complex.

After an argument, Thai allegedly told his accomplices, “shoot them and kill them,” Odwald said.

All five suspects pulled out pistols and began firing at the fleeing victims.

The fifth suspect, Chau Van Phung, was arrested on April 25 in Houston and returned to Orange County. Phung’s preliminary hearing is scheduled for July 15.
