A judge has cleared the way for lawyers to sell the home of white supremacist Tom Metzger to satisfy a $12.5-million judgment in a wrongful-death lawsuit.

Superior Court Judge Lawrence Kapiloff on Tuesday gave Metzger 10 days to appeal the ruling. Attorney James McElroy, who is trying to collect on the judgment, said he will take steps to sell the Fallbrook house as soon as the appeal is resolved.

McElroy represents the family of an Ethiopian immigrant killed by racist skinheads in Oregon in November, 1988. A Portland jury found that the skinheads had been incited by the campaign of racial hatred waged by Metzger, his son, John, and the White Aryan Resistance organization, founded by Metzger.

The judge said McElroy and other attorneys can proceed with the sale of Metzger’s house but must set aside $30,000 from the sale until an appeal by Metzger is resolved.

Metzger had argued that he was entitled to $75,000 from the home, but Kapiloff said he was entitled to only $45,000.

McElroy said the opening bid for Metzger’s home at a sheriff’s auction would be about $120,000.
