GM Sues Company That Performed Crash Tests: General Motors Corp. has filed a lawsuit against an Indianapolis company that performed crash tests for an NBC News investigation into GMC trucks that allegedly are prone to catch fire or explode in accidents. The auto maker is seeking access to the data compiled by the Institute for Safety Analysis and used in a Nov. 17 report on NBC’s “Dateline” program. GM claims the information is flawed. Attorneys for ISA argue that the information is protected by the First Amendment because the company’s head, Bruce E. Enz, was working for NBC as a “news-gatherer.” GM attorney Lloyd H. Milliken Jr. argued in a deposition that the First Amendment protection for journalists doesn’t apply to Enz because he is a source, not a reporter. The suit was filed Jan. 20.
