LOS ANGELES : Bail Set for Man Believed Falsely Convicted of Murder
A federal judge on Thursday ordered bail set for a 28-year-old Compton man who has served eight years in prison for second-degree murder, a crime to which the man’s brother has confessed.
Sheldon Sanders, who is serving a term of 17 years to life in Soledad State Prison, should be released either today or Monday in lieu of a $50,000 surety put up by his parents, attorney Rowan Klein said.
On April 4, the U.S. 9th Circuit Court of Appeals ordered Sanders’ release, saying there were strong signs that he is not guilty and had received incompetent legal assistance. Sanders’ brother, Xavier, had confessed to family members and to an attorney representing Sheldon Sanders, but his statement was never used in court.
A deputy district attorney told the court on Thursday that the district attorney’s office intends to retry Sheldon Sanders.
