Agoura Hills : Landowner Sues Over Rejection of Project
An Agoura Hills landowner has sued the city to force it to reverse its rejection of a proposed family entertainment center at Canwood Street and Derry Avenue, near the Ventura Freeway.
If the city won’t reverse its decision, Ronald Semler should receive “just compensation” for the property, his attorney Roger Sullivan said Monday.
The suit, filed in Los Angeles Superior Court, alleges that the Planning Commission and City Council violated Semler’s private property rights.
The proposed 5 1/2-acre project would have included a miniature golf course and a go-cart track.
The Planning Commission rejected the project in April and the City Council upheld the decision in July. Officials said the project would have disturbed neighbors, many of whom turned out to speak against the project at hearings.
City Atty. Greg Stepanicich said Semler’s claim that the city won’t let him develop his property is not valid, since twice before Semler won city approval for a hotel and retail center at the site but never followed through.
The City Council will discuss the matter in closed session at its regular 7 p.m. meeting Wednesday.
