Produce Stand Owner to Appeal Restrictions

The owner of a produce stand that city officials say has become a small market is expected to appeal orders tonight that he scale it back to its original permitted use.

Scott Souder, owner of Giddings Ranch Market, wants council members to reverse the Planning Commission’s Dec. 9 decision ordering him to remove the storefront he installed and reduce the sale of prepackaged merchandise, now about half his business, to 10%.

Souder installed the storefront to comply with Orange County Health Department regulations affecting stores. But commissioners said his permit allows him to operate only an open air fruit stand, not a store.
