The distributor of an herbal pain reliever has apologized to Mark McGwire for its unauthorized use of his name, and has agreed to pay the St. Louis Cardinal slugger $75,000.
After paying his lawyer, McGwire will donate the rest to charity, his lawyer and agent said.
McGwire sued the distributor, San Diego-based People First Inc., last February in St. Louis Circuit Court. He alleged that the company claimed falsely that he had endorsed a pain reliever called The Freedom Formula.
