Ruling on Disabled
* Re “Disabled Feel the Sting of an Arbitrary Court,” by Erwin Chemerinsky, Commentary, Feb. 26: Why does the Supreme Court specify state governments only? The people of the state are not included in this immunity from the Americans With Disabilities Act, only the governments. Why is it acceptable to respect a state’s sovereignty but not that of the people of the state? Theoretically, state government has certain rights because it represents and serves the people.
Decisions such as this one emphasize the growing gap between the interests of the politicians and the interests of those they supposedly serve. It also is a clear example of why the common citizen has such distrust and disrespect for the legal system. The Supreme Court should revisit this decision with these points in mind.
