Man acquitted of theft from aunt

A Huntington Beach man accused in April of ripping off his

95-year-old great aunt was found not guilty on charges of grand theft

of an elder.

Brett Porr, 32, was arrested on April 24 for allegedly stealing

$50,000 from his aunt, Marcy Sicilano.

He was found not guilty on Aug. 5 of all charges, said Porr’s

Attorney Jeffrey Stivers.

Siciliano moved from New York to Huntington Beach in September of

2001 to live with Porr. At the time Porr and his sister Jessica Silva

began feuding over their great aunt’s savings of nearly $200,000 in

cash and savings bonds that she had brought with her from New York.

Police became involved when Porr sued Silva, who had power of

attorney, for a share of the bonds that were in his name. The two

reached a settlement that afforded him a share of the bonds and

$60,000 to care for his aunt.

Police arrested Porr after he failed to produce receipts proving

that he had used the cash to care for Siciliano. The Orange County

District Attorney charged Porr with false imprisonment of an elder

and damaging property valued at more than $50,000.
