Judge won’t excuse himself from case
A Superior Court judge on Tuesday did not recuse himself from the
statutory-rape trial of a 19-year-old who also faces charges of
gang-raping an unconscious 16-year-old.
Judge Luis Rodriguez set an Oct. 8 date for another hearing to
determine whether a trial date will be set for Greg Haidl. Haidl, the
son of Orange County Assistant Sheriff Don Haidl, is free on $100,000
bail on that case and on another $100,000 bail after a jury
deadlocked on the gang-rape charges against him and 19-year-olds Kyle
Nachreiner and Keith Spann.
Rodriguez has 10 days from Monday to decide if he is going to
respond to a request by Haidl’s defense attorney, Joseph Cavallo, to
recuse himself from the case.
Cavallo filed the motion Monday, asking Rodriguez to remove
himself because the judge is a potential witness in a federal
lawsuit. That lawsuit was brought by the underage girl against the
district attorney and others in connection with a search warrant the
judge signed to obtain her DNA against her will.
The 16-year-old girl admitted to having sex with Haidl while he
was out on bail on the gang-rape charges for a July 2002 incident.
