Attorneys agreed to the following terms on Thursday for the retrial

of Greg Haidl, Keith Spann and Kyle Nachreiner, now scheduled for

Jan. 31, 2005.

* Greg Haidl, Keith Spann and Kyle Nachreiner will be tried

together.

* Prosecutors will not use evidence that Joseph Cavallo offered an

internship to Vanessa Obmann, a witness in the first trial.

* Prosecutors will not use Haidl’s South County statutory-rape

case as evidence that he has a propensity to commit such crimes.

* Prosecutors will not use prescription medications found on a

counter in the home of Haidl’s mother as evidence.

* Prosecutors will not ask GHB expert Trinka Porrata, a

prosecution witness in the first case, to testify.

* Prosecutors will not use date-rape information found on Haidl’s

computer.

* Prosecutors will not use statements by Kevin Rogers, who found

the videotape of the alleged rape.

* Haidl defense attorney Joseph Cavallo will not take part in the

retrial.
