Prosecution rests its case in gang-rape trial

The prosecution in a gang-rape trial rested its case Wednesday.

Rancho Cucamonga residents Kyle Nachreiner and Keith Spann, both

now 20, and 19-year-old Greg Haidl, son of former Orange County

Assistant Sheriff Don Haidl, are accused of gang-raping a

16-year-old-girl and sexually assaulting her with various objects.

The July 2002 incident took place in Don Haidl’s Corona del Mar home.

The prosecution’s last witness, a neurologist who specializes in

sleep disorders, testified that the alleged victim appeared to be

unconscious or sleeping in a videotape of the incident.

The tape was a “trophy,” recorded by the defendants, Chief

Assistant Dist. Atty. Chuck Middleton said during his opening

arguments.

Jane Doe, as the now 19-year-old woman is referred to in court,

passed out after drinking at a party at Haidl’s home and did not give

consent to the defendants, prosecutors allege.

Defense attorneys argue that Doe went to the home with a sexual

encounter in mind and was feigning unconsciousness. They will begin

presenting their case on Monday.

A trial last year on the same case ended in a hung jury. The

defendants face up to 23 years in prison if convicted.
