UCI police waiting to file charges in rape case

UC Irvine police had not submitted a case involving an alleged rape to the Orange County District Attorney’s office as of Friday night, citing a need for further investigation.

UCI student Brian Timothy Russell, 21, was arrested Aug. 25 on suspicion of rape, forcible penetration and oral copulation hours after a female student filed a rape report with campus police. The incident occurred about 1 a.m. in the area of the Vista del Campo apartments on Culver Drive, where Russell and the victim allegedly met during a party.

“The case is not ready for submission at this point,” said UCI Police Chief Paul Henisey. “We need more time for additional investigation.”

Following his arrest, Russell was taken to Orange County Jail where he was booked and later released after posting bail, authorities said.
