Man tries to enter cars at drive-thru, employees say

Police arrested a 38-year-old man on the 1700 block of Newport Boulevard Tuesday morning on suspicion of being under the influence of drugs or alcohol after employees said he was trying to get into cars in the drive-thru and would not leave when they asked, police said.

Troy Phinney of Newport Beach acted bizarrely and mumbled to himself when police encountered him inside the Oh Those Donuts store on Newport Boulevard, Newport Beach police Sgt. Darrel Rainey said.

“He wasn’t answering. He appeared to be under the influence of alcohol and a stimulant,” Rainey said.

Police took Phinney into custody without incident shortly after arriving, Rainey said.
