Man wants drug charges thrown out

A Costa Mesa man may reach a plea deal with prosecutors soon if the judge doesn’t throw out his case on a motion he filed with the court, prosecutors said Friday.

Brian David Heslington, 36, is charged with cocaine and methamphetamine possession after his home was raided, among others, during a multi-police department raid in August 2008.

Police raided his home as part of a large sweep across Southern California to wrangle in members of the biker gangs the Hells Angels and Set Free Soldiers.

Heslington is not a member of either gang, and charges claiming he was were dropped. However, during the search, police found narcotics in his home, according to the search warrant.

Friday, his lawyer made a second attempt to have the warrant, and through that the charges, thrown out. The judge did not make a ruling and took it under advisement.

He is due back in court Sept. 11.
